ANNOUNCEMENT

On: Modification and supplement to Announcement 0780/TM-DM dated July 14th, 2005 on allocation of supplementary quota

- Pursuant to Interministerial Circular 04/2004/TTLT/BTM/BCN dated July 28th, 2004 by the Inter-Ministry of Trade and Industry detailing allocation and realization of quota for textile and garment export to the US market in year 2005 and Interministerial Circular 07/2005/TTLT/BTM/BCN dated April 1st, 2005 providing supplement to Interministerial Circular 04/2004/TTLT/BTM/BCN;

- Pursuant to Announcement 0780/TM-DM dated July 14th, 2005 on allocation of quota in compliance with Announcement 0663/TM-DM dated June 6th, 2005,

The Inter-Ministry of Trade and Industry hereby announces modifications to Announcement 0780/TM-DM dated July 14th, 2005 as follows:

1. Modifications to Clause 5:

After declaration of the list of enterprises to be allocated quota, the Inter-Ministry requires enterprises to send the Quota realization commitment for July, August, and September in accordance with the form attached to the Ministry of Trade prior to July 30th, 2005. If they promises to implement their allocated quota, the Ministry of Trade will send them quota allocation announcement. The announcement will be effective until October 15th, 2005.

Enterprises which are not capable to implement allocated quota, they will inform the Inter-Ministry and the Inter-Ministry will cancel allocation of supplementary quota to them. Enterprises which do not send the commitment to the Ministry of Trade after the deadline will not be given any supplementary quota.

Enterprises which are allocated quota but do not use 98% of their allocated quota before September 30th, 2005 will suffer from a quota deduction as many as the volume they obtain from their remaining quota for same categories, or quota for other categories, or quota they are going to get in next intakes.

2. Modifications to Clause 9:

9 – Remaining quota after allocations will be added to quota source.

Other Clauses of Announcement 0780/TM-DM dated July 14th, 2005 remain unchanged.

The Ministry of Trade hereby notifies enterprises for their acknowledgement and implementation./.
