New rules on business registration

The Government issued Decree No 43/2010/ND-CP on business registration, revising Decree No 88/2006/ND-CP. The most dramatic change is a mechanism for registering an enterprise on the internet using the National Enterprises Registration Information Gate.
Another major change is that each enterprise will be issued an enterprise code on the business registration certificate which also serves as a tax code. This will allow enterprises to carry out only one procedure to change a business registration certificate or tax code registration certificate, helping reduce administrative burdens on enterprises.
The duration for the issuance of a new certificate has also been shortened from 10 to five working days from the date of submission.
The decree also formalises the verification that a proposed enterprise name is not already in use, via a search in the National Enterprises Registration Database. Enterprise names will now be able to include the letters F, J, Z and W, not previously allowed.
